The Goethe-Institut London has contracted the company OVOS to produce an APP for a digital game to assess the learning of German and to improve the teaching of German in secondary schools. The APP offers a foreign language test in the computer game format for pupils of ca. 11-14 years. The game is designed for the students’ enjoyment, recognising their language and IT skills and giving them feedback on their learning progress. It supports teachers by giving them the opportunity to assess the skills of the children of their classes with stress-free test methods and without the need for a huge amount of preparation.

This privacy statement applies to the collection, processing and use of your personal data within the use of the “THE GERMAN QUIZ CHALLENGE” client software for mobile devices (“APP“), downloadable via the Apple App Store and Google Play and developed by ovos media GmbH, Schottenfeldgasse 60/36-38, 1070 Vienna, Austria (“OVOS“).

With regard to the APP, OVOS is the service provider in terms of the German Telemedia Act. (TMG) and the authority responsible in terms of the Federal Data Protection Act (Privacy Act) (BDSG). Permission to Use the APP Will Be Granted to Goethe-Institut e.V: and its members and employees and those teachers and students who have agreed to the TERMS AND CONDITIONS within the game.
 

2. User Account

The German Quiz Challenge (GQC) App is used and played by two different Users:  

The CLASS TEACHER access a web-based dashboard (TEACHER DASHBOARD) through the following https://gqc.micro.ovosplay.com/admin/.

The Pupils (PARTICIPANTS) use the APP provided on Google and App stores. In order to use the app, it is necessary for both users to register and create an Account.
 
  • CLASS TEACHERS: To register through the link provided on the Goethe-Institut London website. Ovos Media and Goethe-Institut e.V process your registration data (e-mail address, name and password). The APP will be used in the presence of, and under the technical guidance of the CLASS TEACHER who can access the APP and the TEACHER DASHBOARD to start and monitor game sessions and access results at all times. CLASS TEACHERS are aware about the APP being an assessment tool and login information to their TEACHER ACCOUNT may not be given to pupils.

  • Teacher’s name
  • Email
  • Password
  • Session Name
  • Blue Print (the version of the game that one wishes to play)
  • Teams‘ names
 
  • PARTICIPANTS: To register through the official GQC App. Ovos Media and Goethe-Institut e.V process your registration data.

Data collected for PARTICIPANTS registration to play a gaming session:
  • Nickname
  • Password

To ensure PARTICIPANTS play completely anonymously, CLASS TEACHERS should advise PARTICIPANTS to only use nicknames only use temporary email addresses and only use a proposed AVATAR as a profile picture.

2.1 Data on your person and content created by you
In the context of creating your CLASS TEACHER or PARTICIPANT account, only those data are required as mandatory data, which we need to carry out our offers or any contractual relationship with you. PARTICIPANTS individual results are stored within the TEACHER DASHBOARD and can be accessed by the TEACHER at all times. TEACHERS can delete the results collected during gaming session by clicking on the respective icon in the game.
We collect and process the data provided by you in the context of the contract execution of this user contract according to Art. 6 Para. 1 lit. b GDPR
You may voluntarily provide further personal information and post content (so-called user-generated content), such as a photo of you, texts in the form of blog or forum posts, discussion posts, etc., to the website. Which data is collected in detail and which information is mandatory and which is voluntary can be seen from the respective input forms. We process the voluntarily provided data in order to protect the predominant common interests in a diverse exchange within the framework of our platform in accordance with Art. 6 para. 1 lit. f GDPR.
 
2.2 Data publishing
If you consent to the processing of your data to create a user account in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. Personal data will at no point be published or be given to a third party. Anonymised data may be used by Ovos and Goethe-Institut e.V. to improve the service.

2.3 Deletion
Deletion of a USER ACCOUNT (TEACHER or PARTICIPANT) is possible within the App itself. After 12 months of inactivity, Accounts are automatically deleted, all data related to the Account is automatically deleted as well. If any user wishes to be deleted from the server and, thus, the relative data cleared completely, please get in touch with either OVOS: support@ovos.at or the Goethe-Institut London: teacher-services-london@goethe.de. Accounts and relative data will need to be cleared manually from the system.

3. Using the App

3.1 Data and settings you specify
To register and use the app you need to enter personal data. Depending on the User (CLASS TEACHER / PARTICIPANT) the data collected applies as follows:
 
Data collected for CLASS TEACHERS registration and for setting up a game session:
  • Teacher’s name
  • Email
  • Password
  • Session Name
  • Blue Print (the version of the game that one wishes to play)
  • Teams‘ names

Data collected for PARTICIPANTS registration to play a gaming session:
  • Nickname
  • Password
  • Email (optional)

To ensure PARTICIPANTS play completely anonymously, CLASS TEACHERS should advise PARTICIPANTS to only use nicknames, only use temporary email addresses and
PARTICIPANTS can also make personal settings in the APP. In the settings PARTICIPANTS can choose to: change AVATAR, change NICKNAME, change PASSWORD, change the setting up language (English, German), clear all downloads, clear everything (including authentication) or delete all personal data.  Email Addresses are asked in order to provide a replacement password in case it is forgotten. If PARTICIPANTS do not register with an email address and forget their passwords, we cannot provide a replacement.
We collect and process this data within the framework of contract processing in accordance with Art. 6 Para. 1 lit. b GDPR in order to provide the functions of the app.
 
3.2 Usage data
The following data is generated when using the app and visible at all time in the TEACHER DASHBOARD:
 
  • PARICIPANTS’ individual results from gaming session
  • PARTICIPANTS’ nicknames. 

We collect and process this data within the framework of contract processing in accordance with Art. 6 Para. 1 lit. b GDPR in order to provide the functions of the app.
 
3.3 Cookies
In order to make the user experience attractive and to enable the use of certain functions, we use so-called cookies. This serves to safeguard our predominantly legitimate interests in the provision of a user-friendly service in accordance with Art. 6 Para. 1 lit. f GDPR as part of a balancing of interests. These small text files are stored on your mobile device.
Cookies remain on your end device and enable us to recognize your app on your next visit and to enable you to log in automatically (persistent cookies).You can deactivate the acceptance of cookies. If cookies are not accepted, the functionality of the app may be restricted.
 
3.4 Web Analytics
The anonymised data generated during the use of the APP by users, which are a) pupils (“PARTICIPANTS”) and b) teachers (“CLASS TEACHERS”) will be stored for the lifetime of the service. Anonymous data is collected by Ovos and analysed by a tool called “Matomo”. Only Goethe-Institut and Ovos have access to this data. Data is summed up in a monthly report and contains information as follows: Visits Summary, Region, City, Device Type, Device Model, Device Brand, Operating System versions, Browsers, Visits per local time, Visits by Day of Week, Length of Visits, Pages per Visits.
 

4. Processor

In order to provide the functions of the app, we use the services of the following service providers who process personal data on our behalf:internex GmbH, Lagerstraße 15, 3950 Gmünd, Österreich, Firmenbuchnummer: 342171v
The legal basis is Art. 28 GDPR (processing).

5. Data security

We protect our systems against loss, destruction, access, alteration or distribution of your data by unauthorized persons through technical and organizational measures, such as
  • hosting the application and all your data in a professional data center within the European Union whose servers are protected against unauthorized access and which also performs frequent data backups
  • the creation of a German Quiz Challenge account with a personal password using SSL encryption
  • fully encrypted communication between the game client and the server at all times
 

6. Your rights and contact details

As a data subject, you have the following rights:
  • pursuant to Art. 15 GDPR, you have the right to request information about your personal data processed by us to the extent specified therein;
  • pursuant to Art. 16 GDPR, you have the right to demand the immediate correction of incorrect or incomplete personal data stored by us;
  • In accordance with Art. 17 GDPR, you have the right to demand the erasure of your personal data stored by us, unless further processing is required;
    • on the exercise of freedom of expression and information;
    • to fulfill a legal obligation;
    • for reasons of public interest, or
    • for the assertion, exercise or defence of legal claims
  • the right, pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data, insofar as
    • the correctness of the data is denied by you;
    • the processing is unlawful, but you refuse to delete it;
    • we no longer need the data, but you need it to assert, exercise or defend legal claims, or
    • you have lodged an objection against the processing under Article 21 GDPR;
  • pursuant to Art. 20 GDPR, you have the right to receive the personal data you have provided to us in a structured, common and machine-readable format or to request transmission to another responsible party;
  • the right to complain to a supervisory authority pursuant to Art. 77 GDPR. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our company headquarters.

If you have any questions regarding the collection, processing or use of your personal data, for information, correction, restriction of the processing or deletion of data as well as revocation of any consent given or objection to a specific use of data as well as regarding the right to data transfer, please contact our company data protection officer (see section 1).
 

7. Right of objection

Insofar as we process personal data as described above in order to safeguard our predominantly legitimate interests as part of a weighing of interests, you may object to this processing with effect for the future. If the processing is carried out for direct marketing purposes, you may exercise this right at any time as described above. Insofar as processing is carried out for other purposes, you are only entitled to object if there are reasons arising from your particular situation.
After exercising your right of objection, we will not process your personal data further for these purposes unless we can prove compelling reasons for processing worthy of protection which outweigh your interests, rights and freedoms, or if the processing serves the assertion, exercise or defence of legal claims.
This does not apply if the processing is carried out for the purposes of direct marketing. Then we will not further process your personal data for this purpose.
