  1. Invitation to Tender

    The Goethe-Institut e.V. hereby invites qualified and experienced individuals or service providers to submit proposals for the appointment of a Public Officer in terms of the Income Tax Act, 58 of 1962, and other relevant South African legislation.

    The appointed Public Officer will act as the company’s official representative to the South African Revenue Service (SARS) and other statutory bodies, ensuring full compliance with all corporate, tax, and governance requirements.

  2. Scope of Work

    A successful appointee will be required to:

    • Act as the registered Public Officer of the Goethe-Institut e.V. as required by law.
    • Liaise with SARS and ensure all statutory returns and communications are properly handled.
    • Ensure the company complies with relevant tax, labour, and company legislation.
    • Oversee and coordinate the submission of all tax returns and related documents.
    • Maintain official company records and statutory documents.
    • Represent the company in official correspondence and interactions with government authorities.
    • Provide regular compliance and governance reports to the Board of Directors.
    • Advise management on legislative changes affecting company operations.
  3. Minimum Requirements

    Prospective bidders must meet the following criteria:


    Statutory Eligibility

    Must be ordinarily resident in South Africa for tax purposes and have a fixed place of business or registered address in South Africa and must be formally appointed and authorized by the Board of Directors through a written resolution, must not have been declared insolvent, convicted of an offence involving dishonesty, or disqualified from managing a company under the Companies Act, 2008 and be in good standing with SARS and other regulatory bodies and have a clean professional and disciplinary record (valid SARS Tax Clearance Certificate) and be registered with the National Treasury’s Central Supplier Database (CSD).

    Professional Requirements

    Must have a minimum of five (5) years’ experience in legal, tax, or compliance-related work, demonstrated experience dealing with SARS, CIPC, or similar regulatory entities (provide contactable references from at least three (3) clients for whom similar services were provided) and proven familiarity with German legal principles or experience working with German-based organizations and extensive knowledge in South African corporate, tax, and non-profit law, SARS procedures and PBO/Section 18A compliance, (possess sound knowledge of the Companies Act, 71, Income Tax Act, 58, POPIA (Protection of Personal Information Act), Employment Equity and Labour Regulations), exchange control and cross-border regulatory issues, understanding of dual legal environments (South Africa and Germany), fluent in English (both written and spoken) and proficient in German.

    Personal and Ethical Attributes

    Demonstrate integrity, professionalism, and reliability, strong organizational and communication skills, commitment to transparency and accountability and ability to exercise sound legal and ethical judgment.

  4. Evaluation Criteria

    Proposals will be evaluated in accordance with the Preferential Procurement Policy Framework Act (PPPFA) using the following point system, based on:

    1. Cost and Pricing Transparency (30%)

      Clarity of pricing model (setup fees, per-employee charges, additional services), value for money, flexibility for non-profit budgets.
    2. Service & Support (40%)
       
    3. Contractual Terms & Service Level Agreements (SLAs) (30%)

      Fair contract terms, clear service level agreements, notice periods, and liability clauses.
