Information on the processing of personal data in accordance with Art. 13 and 14 of the German Federal Data Protection Ordinance (DSGVO)

PURPOSE

We process your data in order to complete the application procedure for the funding of a co-production within the framework of the Visual Arts Project Fund.

Legal Basis

Data processing is only permissible if one or more of the legal bases listed below apply.

1. Consent (Art. 6 Para. 1 a) DSGVO)
​Processing is based on your consent. This is the legal basis for the processing. Consent is voluntary. You can revoke your consent at any time with effect for the future.

2. Fulfilment of contractual obligations  (Art. 6 para. 1 b) DSGVO)
​Processing is based on contractual obligations between you and the Goethe-Institut. The personal data is required for the implementation of the legal relationship.

3. Fulfilment of legal obligations (Art. 6 para. 1 c) DSGVO)
Processing is based on its necessity for the fulfilment of legal obligations to which the Goethe-Institut is subject. We may process your data for the purposes of identity verification, fulfilment of tax obligations and documentation in the event of an inspection by a government authority. The disclosure of personal data may become necessary within the framework of official or judicial measures for the purpose of gathering evidence, criminal prosecution or the enforcement of civil law claims.

4. Safeguarding of legitimate interests (Art. 6 Para. 1 f) DSGVO)
​Processing is based on a legitimate interest on the part of the Goethe-Institut or a third party.

We process the following data about you:
  • Project partners’ names
  • Address
  • Telephone number
  • Email address
  • Project title and brief description
  • Contact persons’ address (street, city/town, country)
  • Homepage address / advertising presence
  • Social Media inputs (Facebook, Instagram, Soundcloud, YouTube, Vimeo, etc.)
  • Genre(s)
  • Number of artists/curators involved in the production
  • Names, functions and domiciles of all participating artists/curators
  • Travel data, information on project data
  • Sponsors, additional partners
  • Cost/financing plan
  • Audiovisual formats
  • Any other documentation that you enclose with the application (artistic/curatorial concept, biographies of the partners/artists/curators, schedule, confirmations of partners and sponsors)
  • Information on previous contact with the Goethe-Institut's Visual Arts Division
  • An identification number assigned by us to your application
  • Visual and video material relating to the production resulting from the funding
  • Our notes on your funding application
In the case of processing in accordance with Art. 6 para. 1 b) DSGVO, the following applies: The contract cannot be concluded without the data that you provide us with prior to the conclusion of the contract.

Transfer To Third Parties

Your personal data may be passed on to third parties. The recipients of your data may be the jury members of the Visual Arts Project Fund, the German Foreign Office, German embassies abroad and other project organisers in Germany and abroad. For the operation and maintenance of our technical systems on which the data is stored, we sometimes use external IT service providers, who can thus gain access to your data. These service providers are carefully selected by us and commissioned in writing. They are strictly bound by our instructions and are regularly checked by us.

Transfer To A Third Country

Your personal data can be transferred to so-called third countries. These are the locations of the Goethe-Instituts abroad. Insofar as your data leave the EU/EEA area in the process, we ensure an appropriate level of data protection for the transfer to these third countries by agreement upon EU standard data protection clauses with the Goethe-Instituts located there, which have been issued by the European Commission for this purpose. You can obtain a copy of this agreement from us on request. Please use the above contact details. Depending on your needs, your data may also be transferred to the German Foreign Office, German embassies abroad and other project organisers abroad. We hereby advise you that in so-called third countries no adequate level of data protection in accordance with European standards can be guaranteed.

Duration Of Data Storage

We store your data for as long as they are required for one of the above-mentioned purposes or a statutory retention period is prescribed.

Your Rights And Contact Options

Information: On request, we will be happy to inform you whether and which data about you are stored.
Correction, restriction of processing or deletion: To the extent that statutory requirements are met, you have the right to correct, restrict processing or delete this data.
Data issuance: You also have the right to receive from us the data relating to you which you have provided us with in a structured, standard and machine-readable format; you may transmit this data or have it transmitted to other parties.
 
Objection: You may at any time object to the processing of your data, which is carried out on the legal basis of Art. 6 para. 1 letter f) DPA, for reasons arising from your specific situation. We will then no longer process your data unless we can prove that there are overriding compelling reasons for processing which merit protection or the processing serves to assert, exercise or defend legal claims.

Appeal to supervisory authorities

You also have a right of appeal to the competent supervisory authorities for data protection.
This is the website of the German Federal Commissioner for Data Protection and Freedom of Information, Graurheindorfer Straße 131, 53117 Bonn, Germany www.bfdi.bund.de.You can also lodge your complaint with any other data protection authority. This will then be forwarded to the appropriate supervisory authority.
